MONTGOMERY, Ala., April 7.The Supreme Court has rendered a decision reversing and remanding the case of Gabe Harvey, convicted of the murder of his mother-in-law in Barbour County. The woman, whose name was Berry, disappeared one night. A search was instituted and her dead body was found in a shallow grave near Harveys cabin. The man bore a bad reputation and had had trouble with the woman.
When the case came up for trial Clayton and McDowell were appointed to defend Harvey. The case rested entirely on circumstantial evidence and he was convicted and given a death sentence. His lawyers carried his case to the Supreme Court and secured a reversal. They believe that an acquittal will be the result of the next trial.
