Killed by an Army Officer - A telegram to the New York Sun from Pittsburgh, Texas, February 11, says: The stranger who yesterday shot and killed G. M. D. SMART proves to be J. W. HEARD, a second lieutenant in the United States army, whose command is stationed in Arizona. He had an examining trial to-day before County Judge BROOKS, and was dis charged without bail, the evidence showing that he was justified in killing SMART. W. H. BURRAGE and J. H. HESS have been indicted for assault with intent to kill Lieut. HEARD, at whom they fired several shots after he had killed SMART in self-defense and was retreating.
