Demurrer Sustained
In the case of the State vs. T. E. Mortimer, charged with unlawfully obtaining money from the school fund of Tippah county by reason of making false report of attendance upon said school, the demurrer to the indictment, interposed by the defendant, was sustained last week at Ripley by Judge Lowrey. It is thought to be unlikely that another indictment will be returned because of the fact that there is no statute in the State covering false school reports along the lines indicated in this indictment.
