ANOTHER JUDGE DECIDED BUCKET SHOP LEGAL

Washington, D. C., April 1 – Justice Ashley M. Gould, of the supreme court of the District of Columbia, announced today his determination to adopt the opinion of Justice W. Wright, declaring unconstitutional the attempt by congress to pass special “anti-bucketing” legislation.
Justice Gould is in full accord with the finding of Justice Wright that the statute violates the liberty of contract protected by the constitution and that it attempts to penalize an innocent customer, if the broker intends that the transaction shall be “bucketed.”
Justice Gould has had under consideration the demurrers filed by Price & Co., of Baltimore to an indictment charging William B. Price and eight others with conspiracy and another indictment with conducting a bucketshop.
That the victory gained by the decision of Justice Wright and the coincidence of Justice Gould will be a “vacant” one in the court of appeals should sustain the invalidity of the law, is an opinion expressed today by members of the local bar.
Since the court of appeals, they point out, has decided in the case that a bucketshop is a gambling place under the code which prohibits setting up a gaming table, it will only be necessary for the government to secure new indictments charging conspiracy to commit the crime of gaming.
The believe is expressed that such indictments would hold, in view of the fact that the federal court of appeals in criminal cases in the district has decided against the bucketshops.
