Kilborne Terrell Co. Ga. page 69-70 Georgia, Terrell County: It being represented to the Court by the petition of W.C. Carter administrator of Robert M. Carter deceased, that by Deed of Mortgate dated the 10th day of November, 1858, James R. Bynum conveyed to the said Robert M. Carter, a lot of land situate, lying and being in the town of Dawson, in said county of Terrell, Containing six-tenths of an acre, more or less, known by plan H 96 for purposes of security payment of 2 certain promisory notes made by the said James R B ynum to said Robert M. Carter one due 25 Feb 1860 for $750 each making sum $1500 which note all now due and unpaid. It is ordered that said James R Bynum do pay into court by last day next term principal, interest and cost due or show cause, if any he had, to the contrary, or that in default therein of a foreclosure he granted to the said W.C. Carter, Adm. as aforesaid of said mortgate and the equity of redemption of the said James. R. Bynum therein be forever barred, and that service of this rule be perfected on said James R. Bynum according to law.
